<div><span>The Supreme Court on Monday issued notice to the Election Commission of India (ECI), the Centre, the Chief Electoral Officer and the Maharashtra government on a petition challenging the Special Intensive Revision (SIR) of electoral rolls in Maharashtra over alleged large-scale voter deletions.</span></div><div><span>However, the court declined to extend the deadline for filing claims and objections or halt publication of the final voters’ list without first hearing the poll body.</span></div><div><span>A Bench comprising Chief Justice of India (CJI) Surya Kant and Justices Joymalya Bagchi and V. Mohana scheduled the next hearing for November 5.</span></div><div><span>The petition, filed by Arun Anandagiri, challenges the deletion of names from the draft electoral rolls and the procedure prescribed for voters seeking to have their names restored.</span></div><h2><span>Plea flags deletion of nearly 3 crore voters</span></h2><div><span>Appearing for the petitioner, senior advocate Arvind P. Datar told the court that nearly 33 per cent of Maharashtra’s approximately nine crore voters, around three crore people had been removed following the publication of the draft electoral rolls.</span></div><div><span>Of these, 1.22 crore voters had been deleted on the ground of “logical discrepancy”, Datar submitted.</span></div><div><span>He argued that voters whose names had been removed were being asked to submit Form 6, which is intended for fresh voter registration, despite having voted in previous elections.</span></div><div><span>According to the senior advocate, this requirement could expose existing voters to allegations of making a false declaration, as applicants must state that they have not been registered as voters previously.</span></div><div><span>Referring to a recent Delhi High Court order, Datar argued that an assurance against prosecution did not address the underlying issue. He urged the Supreme Court to direct the ECI to introduce a separate form for voters whose names had been deleted during the revision exercise.</span></div><div><span>“Nobody will be prosecuted,” the Bench led by CJI Surya Kant assured the petitioner’s counsel.</span></div><h2><span>Court reluctant to grant immediate relief</span></h2><div><span>Datar also sought an extension of the deadline for filing claims and objections, which fell on Monday, and asked the court to restrain the ECI from finalising the electoral rolls until the dispute was adjudicated.</span></div><div><span>He argued that Maharashtra did not face any immediate election that required the list to be finalised according to the existing schedule.</span></div><div><span>The Bench, however, was reluctant to pass an order without first hearing the poll body. It noted that the Supreme Court had extended deadlines during SIR exercises in other states and indicated that appropriate directions could be considered after examining the circumstances.</span></div><div><span>The matter will now be taken up on November 5.</span></div><h2><span>Maharashtra SIR schedule</span></h2><div><span>Under the revised schedule, the draft electoral roll in Maharashtra was published on August 31, while the deadline for filing claims and objections was extended until October 26.</span></div><div><span>The disposal of claims and objections is scheduled to continue until November 10. The final electoral roll is due to be published on November 16.</span></div><h2><span>Supreme Court had earlier upheld ECI’s authority</span></h2><div><span>The Supreme Court had previously upheld the ECI’s authority to conduct the SIR exercise, ruling that the revision fell within the poll body’s constitutional and statutory powers. The exercise, it said, was intended to protect the integrity of electoral rolls and ensure free and fair elections.</span></div><div><span>In its judgment delivered on May 27, the apex court held that the exercise was authorised under Article 324 of the Constitution, read with Section 21(3) of the Representation of the People Act, 1950.</span></div><div><span>The court also ruled that procedural safeguards were in place to prevent arbitrary exclusion from electoral rolls.</span></div><div><span>It further clarified that the ECI could examine questions relating to citizenship for electoral purposes, while making clear that such scrutiny would not amount to a final determination of an individual’s citizenship.</span></div><div><span>(with IANS inputs)</span></div>

<p>The Congress will strongly reiterate its demand for the removal of Chief Election Commissioner Gyanesh Kumar at the INDIA bloc’s rally in Delhi on November 1, Haryana Congress in-charge Sanjay Dutt and state unit president Rao Narendra Singh said on Saturday, according to reports.</p><p>The leaders emphasised that maintaining the integrity of electoral rolls, ensuring transparency in the electoral process and safeguarding every eligible citizen’s right to vote were essential to the country’s democracy. They asserted that the Congress would not compromise on these principles.</p><p>Dutt and Singh said the Congress’s nationwide ‘Vote Bachao Desh Bachao’ campaign had reached a crucial stage, with preparations being stepped up across Haryana to expand its reach to every district, block, village and polling booth.</p><p>According to reports, party workers have been instructed to document alleged irregularities in electoral rolls, raise awareness about eligible voters’ rights and mobilise a large contingent from Haryana for the November 1 rally.</p><p>The INDIA bloc’s rally at Delhi’s Ramlila Maidan is being projected as the culmination of the ‘Delhi Chalo’ march against alleged irregularities in the Election Commission’s functioning and the Special Intensive Revision (SIR) of electoral rolls.</p><p>The Congress has said that at least 10 lakh people are expected to participate in the march to protest what it describes as ‘vote chori’. The party added that the rally would convey a strong message of unity in defence of democracy and the Constitution.</p><p>Dutt described the ‘Vote Bachao Desh Bachao’ rally as part of a nationwide movement to safeguard citizens’ voting rights, strengthen democratic institutions and hold the BJP government accountable.</p><p>Dutt and Singh said concerns over the alleged lack of impartiality in the electoral process could not be adequately addressed while Gyanesh Kumar remained in office, asserting that his removal was necessary.</p><p>They further stated that if an investigation established his involvement in undermining the democratic system or violating the law, appropriate legal action, including arrest, should be taken.</p><p>Dutt questioned the Chief Election Commissioner’s role, stating that the Election Commission had a constitutional duty to ensure transparency and impartiality in the electoral process. He stressed that concerns regarding the potential removal of eligible voters’ names and discrepancies reported during the revision of electoral rolls required serious consideration.</p>

<p>Documents revealed under a Right to Information (RTI) filing indicate that complaint letters sent internally by the Election Commissioners, Sukhbir Sandhu and Vivek Joshi, have been directly sent to the Chief Election Commissioner (CEC), Gyanesh Kumar.</p><p>These letters, which included complaints about administrative misconduct by Senior Deputy Election Commissioner (DEC), Maneesh Garg, were also sent to the Department of Personnel and Training (DoPT).</p><h2><strong>Confidential communications in RTI filings reveal handling of ECI dispute</strong></h2><p>Official documents obtained under RTI filing detail how the executive offices handled confidential communications received by Sandhu and Joshi.</p><p>Internal proposal: In an internal proposal filed on August 3, it was suggested to seek an opinion of CEC Gyanesh Kumar in regard to the complaints made by the two election commissioners.</p><p>Individual capacity: In an internal note filed on August 4, it was stated that these letters should be considered individual communications of the two commissioners and not as an official communication of ECI.</p><p><strong>Formal acknowledgements</strong>: Formal acknowledgement letters dated August 5 were sent to the Secretary of DoPT, the Establishment Officer, and the Principal Private Secretary of the CEC.</p><h2><strong>Dispute centered on ECI IT department protocol changes</strong></h2><p>The underlying rift stems from contentious administrative changes executed within the ECI's Information Technology division.</p><p>In their confidential letters, Sandhu and Joshi pointed out that DEC Maneesh Garg assumed additional charge of the Administration Division on July 28 while DEC Bhanu Prakash Yeturu was on leave. Within hours, Garg issued new work-allocation orders affecting senior officials without consulting the commission.</p><p>Both commissioners cited Sections 18(1) and 18(2) of the 2023 CEC/EC Act, while Commissioner Joshi noted that requested administrative files were withheld from his office. The IT division updates subsequently drew national scrutiny following reports that new system protocols restricted Electoral Registration Officers (EROs) from directly managing voter roll databases.</p><h2><strong>ECI rejects reports of internal divisions</strong></h2><p>Despite documentary evidence of written grievances sent to the Cabinet Secretariat, the Election Commission denied claims of institutional breakdown.</p><p>The Commission maintained that all operational decisions, including IT infrastructure updates, continue to be passed either unanimously or through majority consensus in full compliance with statutory protocols.</p>

<p>For eliminating voter duplication, the Election Commission of India (ECI) adopts a strategy comprising digitisation of voter databases, automatic matching of voter details using algorithms, and field verification by Booth Level Officers (BLOs). Post the directives issued by Uttar Pradesh Chief Electoral Officer Navdeep Rinwa prior to the publication of draft electoral roll, double registrations being detected through SIR process are being rectified by election authorities in respective districts.</p><p>1. Matching using AI through ECINET portal</p><p>Unified ECINET Portal of ECI consolidates voter lists of all states and Union territories into a single database.</p><p>Automated screening: The software algorithms match the national database to detect two anomaly reports – Photo Similar Entries (PSE) and Demographic Similar Entries (DSE).</p><p>Data matching parameters: The system detects potential matches after screening image similarity along with name, relative details, age, and address.</p><p>Review process: The Electoral Registration Officers (EROs) screen the matches and classify them as positive matches, no matches, or doubtful cases requiring physical verification.</p><p>2. Elimination of duplicate EPIC numbers</p><p>To rectify mistakes resulting out of earlier decentralized issuance process, the ECI conducted nationwide campaign for allocation of uniform EPIC numbers to voters.</p><p>The election authorities explained that the duplicate alphanumeric EPIC series was the result of overlapping administrative history and not due to the creation of fraudulent voters. The voters were assigned unique EPIC numbers after checking throughout the country.</p><p>3. Voluntary identity verification and field deletion process</p><p>As per the statutory process, an ERO cannot delete any entry solely based on matching through algorithms. Physical verification is statutorily compulsory.</p><p>Ground verification: The BLO visits the address physically and checks whether the elector actually resides there.</p><p>Statutory deletion notice: In case of duplication at different addresses or polling stations, the entry of the old address is deleted using Form 7 after serving a statutory notice to the elector.</p><p>Inter-state coordination: For cross-constituency or inter-state duplications, coordination must be obtained between the respective districts' election authorities before deletion of the record.</p>
