The Bombay High Court on Monday deferred the hearing on actor Imran Khan’s writ petition challenging the Foreigners Regional Registration Office’s (FRRO) ‘Leave India’ notice to November 2 at 3:00 PM, after the Centre requested additional time to file its response.The division bench comprised Chief Justice Mahesh Chandra Tripathi and Justice Advait Sethna. Crucially, the court directed that the FRRO order be kept in abeyance in the interim, ensuring that no coercive action or deportation steps will be initiated against the actor before the next hearing. The ruling provides immediate relief to Khan, whose exit deadline was originally set for Tuesday, October 28.<h3 data-path-to-node="5">Oral assurance in court: 'Nothing will happen'</h3>During the proceedings, senior advocate Venkatesh Dhond, representing Imran Khan, highlighted the urgency of the petition, noting, "But I have to leave tomorrow."Responding to the court on behalf of the government, the law officer assured the bench that the matter could be safely listed for the following Monday, stating, "Nothing will happen. That is an oral assurance." Taking note of the Centre's commitment, the bench ordered the notice to remain suspended until the matter is heard next week.<h3 data-path-to-node="9">Origin of the dispute: Detained during Mumbai protest</h3>The legal battle stems from an incident on October 10, when Mumbai Police detained Imran Khan near August Kranti Maidan during a public protest demanding the resignation of Chief Election Commissioner Gyanesh Kumar over the Special Intensive Revision (SIR) of electoral rolls. Khan’s partner, Lekha Washington, and cousin, Zayn Marie Khan, were also detained during the demonstration.Four days later, on October 14, the FRRO issued a Leave India Notice (LIN) directing the actor—who holds US citizenship alongside an Overseas Citizen of India (OCI) card—to leave the country by October 28 under Sections 7(2)(C) and 29 of the Immigration and Foreigners Act, 2025.<h3 data-path-to-node="13">Imran Khan challenges notice as arbitrary violation of rights</h3>In response to the FRRO directive, Khan filed a writ petition titled Imran Khan Pal v. Union of India &amp; Ors, through his legal team comprising Zulfiquar Memon, Parvez Memon, and Kunal Vajani.The petition argues that the exit notice is arbitrary, unconstitutional, and a direct violation of his fundamental rights under Articles 14 and 21 of the Indian Constitution. Furthermore, Khan’s counsel questioned the procedure followed by the authorities, pointing out that the actor was denied a prior hearing or a fair opportunity to respond via a standard show-cause notice before the order was issued.Known for his breakout debut in Jaane Tu... Ya Jaane Na and hit films such as Delhi Belly, Break Ke Baad, Ek Main Aur Ekk Tu, and Mere Brother Ki Dulhan, the actor will now await the High Court's detailed review of the matter on November 2.

The High Court deferred the hearing on actor Imran Khan’s petition challenging the notice directing him to leave India by October 28. The matter has been kept for hearing on Tuesday at 3 pm. Imran Khan has filed a writ petition before the Bombay High Court challenging a Leave India Notice (LIN) dated October 14, 2026, issued by the Foreigners Regional Registration Officer (FRRO), Mumbai, directing him to leave India on or before October 28, 2026. Imran Khan's PR team issued a statement,  "Mr Imran Khan Pal, actor and Overseas Citizen of India (OCI) Cardholder residing in India since the age of 2 years, has filed a Writ Petition before the Hon'ble Bombay High Court challenging the Leave India Notice dated 14.10.2026 (“LIN”) issued by the Foreigners Regional Registration Officer (FRRO), Mumbai, which directs him to leave India on or before 28.10.2026. The petition challenges the procedure the FRRO adopted. The FRRO concluded that Imran, a US National, had taken part in a protest, and on that basis ordered him to leave India. It did so without giving him any opportunity of being heard." The actor’s petition argues that the notice does not specify the provisions of the Immigration and Foreigners Act, 2025, that he allegedly violated. It also contends that the notice was issued without a show-cause notice or an opportunity to be heard. In his petition, Khan has sought quashing of the October 14 notice, contending that it does not specify the provisions of the Immigration and Foreigners Act, 2025, that he allegedly violated. He has also argued that the notice was issued without a show-cause notice or an opportunity to be heard. According to the petition, Khan has held Overseas Citizen of India (OCI) status since 2006 and has lived in India since he was about two years old. He has cited his education, professional work and family ties in the country to underline his longstanding association with India. The petition states that Khan received the notice on October 15 and was directed to leave the country by October 28.  It argues that the notice does not identify the specific legal provisions allegedly contravened or provide details of the material on which the authorities relied while issuing the direction. The actor has linked the notice to an incident on October 10 near August Kranti Maidan and Nana Chowk in Mumbai, where he says he was briefly detained by police.  According to his account, he was returning to his vehicle when he was surrounded by media personnel and apprehended by the police.  He has denied entering any restricted or barricaded area or disobeying police directions to leave. However, his team clarifies that Imran was "neither an organiser of nor a participant in the protest", "Shortly after the petition was filed this evening, the FRRO issued a detailed show cause notice (“SCN”). The notice asks Imran to explain why his OCI registration should not be cancelled because of his presence at the gathering of 10.10.2026, where he was briefly detained by the Mumbai Police. Imran was neither an organiser of nor a participant in the protest. He had gone to see what was happening. Before he could reach the site, he was surrounded by the media and detained by the police."  The petition further states that Khan was taken to the Yellow Gate Police Station along with family members and was subsequently released. It refers to an FIR registered at Gamdevi Police Station on October 10 under provisions of the Bharatiya Nyaya Sanhita (BNS). Khan has contended that the notice appears to have been issued in connection with the FIR, despite the allegations remaining unproven.  The petition also points out that, according to him, no chargesheet had been filed and no charges framed when the notice was issued. Arguing that the direction to leave India has serious consequences for him, Khan has challenged the action as disproportionate and in violation of the legal safeguards he claims are applicable in his case.  He has also raised concerns over the circumstances and timing of the notice, including what he describes as public calls for action against him. The petition seeks quashing of the notice and disclosure of the records and material relied upon by the FRRO. Khan has also sought interim protection against coercive steps, including his removal or deportation from India, blacklisting, or any action affecting his OCI registration while the matter is pending before the court.
