The Election Commission of India (ECI) has told the Supreme Court that a petition seeking to restrain Chief Election Commissioner (CEC) Gyanesh Kumar from functioning is not legally maintainable, arguing that the CEC can be removed only in the same manner and on the same grounds as a Supreme Court judge.

In a counter-affidavit filed before the apex court, the poll body defended its decision-making process and the conduct of the Special Intensive Revision (SIR) of electoral rolls, maintaining that the orders initiating the exercise were issued unanimously.

The ECI said the petition, which questions whether the CEC can individually exercise or represent powers vested in the multi-member Commission, relies entirely on a single newspaper report and seeks extraordinary relief without establishing the factual basis for its allegations.

"The averments in the Writ Petition are admittedly based solely on a single newspaper report," the affidavit stated. It added that the petitioner had neither sought to verify the facts with the Commission nor made any representation to it.

The poll body further noted that the petitioner had described the material as an "investigative reportage" requiring verification. It argued that a newspaper report could not, by itself, be treated as proof of the facts it contained.

"A public interest petition built on such material calls for its conclusions to be examined with circumspection," the affidavit stated.

The ECI also submitted that the petitioner had not disputed the legality of the Commission's constitution and had accepted that Gyanesh Kumar was duly appointed as CEC. It, therefore, argued that the plea seeking a writ of quo warranto was misconceived.

ECI cites constitutional protection for CEC

Opposing the request to prevent Kumar from functioning, the ECI invoked Article 324(5) of the Constitution, which provides that the CEC cannot be removed from office except in the same manner and on the same grounds as a judge of the Supreme Court.

"The prayers in the Writ Petition for passing of an order restraining the CEC would not be maintainable," the affidavit stated.

The Commission also cited Section 18 of the Chief Election Commissioner and other Election Commissioners (Appointment, Conditions of Service and Term of Office) Act, 2023, which governs how the poll body conducts its business.

Under the provision, the Commission must endeavour to reach decisions unanimously, with matters on which its members differ being decided by a majority.

The ECI argued that restraining the CEC would interfere with the functioning of the constitutional body and its statutory decision-making process.

"Any such prayer shall also not be maintainable being in the teeth of/contrary to the provisions of Section 18 of the 2023 Act," it submitted.

ECI says SIR orders were unanimous

The counter-affidavit, filed through Deputy Election Commissioner Bhanu Prakash Yeturu, said decisions on matters placed before the Commission were taken after deliberations. Files and relevant documents were circulated among the CEC and the two Election Commissioners for approval, with decisions recorded in official files and implemented through the ECI Secretariat.

The affidavit also stated that the counter-affidavit itself had been approved unanimously by all three members of the Commission.

It clarified that suggestions, observations or queries exchanged among members or with officials during deliberations did not, by themselves, constitute a decision of the Commission under Section 18 of the 2023 Act.

The ECI maintained that its orders initiating the SIR exercise on June 24, 2025, October 27, 2025, and May 14, 2026, were issued unanimously and in compliance with Article 324 of the Constitution and the applicable laws.

ECI defends Form 6 changes and SIR process

Responding to allegations that it had improperly amended Form 6, the Commission said the declaration accompanying applications for inclusion in electoral rolls was a separate document prescribed under the SIR orders. It maintained that the declaration did not form part of the statutory Form 6 under the Registration of Electors Rules, 1960.

According to the ECI, the revised declaration allows applicants to provide details linking themselves, their parents or their grandparents to earlier electoral rolls. This could help applicants avoid submitting additional documents during the claims and objections stage.

The poll body also referred to the Supreme Court's May 27, 2026, judgment, which upheld the documentation framework for the SIR exercise and recognised the ECI's authority to prescribe an appropriate framework, provided it had a rational connection with the objective being pursued.

The affidavit said the SIR was being conducted in accordance with the applicable law. It added that measures had been taken to assist voters, including home visits by Booth Level Officers (BLOs) to collect documents from people who received notices over discrepancies or the absence of links with previous electoral rolls.

The ECI urged the Supreme Court to dismiss the petitions, arguing that the allegations against the Commission were misconceived and that the reliefs sought were not legally maintainable.

(With IANS inputs)

In a counter-affidavit filed before the apex court, the poll body defended its decision-making process and the conduct of the Special Intensive Revision (SIR) of electoral rolls, maintaining that the orders initiating the exercise were issued unanimously.

Former England off-spinner Gareth Batty will step down as Surrey head coach to join five-time Indian Premier League (IPL) champions Chennai Super Kings (CSK) as an assistant coach for the tournament’s 2027 season, the county club said on Monday.

CSK had previously got former India left-arm pacer Zaheer Khan as their new head coach, with former fast bowler Mohit Sharma also in line to join the team as their new bowling coach.

The move brings down the curtain on Batty’s 21-year association with Surrey – serving the club as a player, captain and then coach. Batty took charge as head coach in 2022 and guided Surrey to three successive County Championship titles.

In doing so, they became the first team in nearly six decades to win the title three years running. Surrey won the County Championship in 2022, his first season in charge, and retained it in the 2023 and 2024 seasons before finishing second in the 2025 edition. Under him, the club also reached the knockout stages of the T20 Blast in each of his five seasons, including two appearances at Finals Day.

“Thank you hardly seems enough for all that Surrey has meant to me. It has been a privilege to serve this great club, to share in its success and challenges. The new journey is a very exciting one for my family and me with CSK in the IPL, and I’m looking forward to getting going.

“I would like to make a special thank you to Stewie; he has been there throughout -- thank you for the memories and your belief in me, boss. Clubs are built on more than results and trophies; they are built on people, loyalty and a shared sense of purpose, and I look forward to my third chapter as a fan. Thank you,” said Batty in a statement issued by Surrey on Monday.

Beyond the trophy triumphs, Batty’s tenure also saw a number of Surrey first-team players graduate to the England set-up. Batty played for Surrey between 1998 and 2001 before returning in 2010. He captained the side from 2015 to 2017 before handing over to current skipper Rory Burns, and moved straight into the coaching staff after retiring as a player in 2021.

Batty made more than 350 appearances for Surrey, claiming over 500 wickets across formats, and is the club’s joint-highest wicket-taker in T20 cricket. He also played 20 times for England across all three formats, and picked 20 wickets overall.

Surrey’s Director of Cricket Alec Stewart paid rich tribute to the outgoing Batty. “It is difficult to put into words just how much Gareth Batty has given to Surrey County Cricket Club, both as a player and as Head Coach.

“I have known and worked with Gareth for many years, and throughout that time he has shown an outstanding commitment to this Club. As a player and then as Captain, he has always put the team first and played a significant role in helping to move the Club forward.

“He has a passion and knowledge for the game as well as a determination to get the very best out of himself and those around him. When he made the transition into coaching, he brought those same qualities with him.

“Taking on the role of Head Coach is never straightforward, particularly at a Club with the expectations and traditions of Surrey. Gareth embraced that challenge, and his achievement in leading the side to three consecutive County Championship titles is a reflection of his hard work, his understanding of the players and his fierce will to win.

“Gareth has always cared deeply about the Club. He demands a great deal of himself and those around him, because he wants Surrey to be successful and wants every player to fulfil their potential,” he said.

Stewart also thanked Batty on a personal level and acknowledged the sacrifices made by his family. “On a personal level, I would like to thank him for everything he has contributed to Surrey throughout his time at the Kia Oval. We share a love of the Club and a determination to see Surrey continue to succeed, and we can look back with considerable pride on what has been achieved, both on and off the field during his time as Head Coach.

“I would also like to thank his family for their understanding and patience with what the role has demanded from him over the last five years. Whilst we are sorry to see him go, I understand that this opportunity was too good for him to pass up and will enable him to spend more time with his family outside of the IPL season.

“He leaves with the very best wishes of everyone at the Club. Gareth may have been born a Yorkshireman, but he was made in Surrey and has had an incredible impact on the Club,” added Stewart.

The CSK move brings down the curtain on Gareth Batty’s 21-year association with Surrey - serving the club as a player, captain and then coach. Batty took charge as head coach in 2022 and guided Surrey to three successive County Championship titles.

India's campaign at the Men's Hockey Asian Champions Trophy 2026 has been dealt a severe setback, with veteran midfielder and former captain Manpreet Singh officially ruled out of the tournament due to a calf muscle injury.

The news was confirmed by India captain Harmanpreet Singh at the captains' press conference in Jalandhar, a day before the hosts open their campaign against Bangladesh on Tuesday.

Vivek Sagar Prasad has been named as the replacement in the squad. The midfielder, who has established himself as a reliable presence in the Indian midfield, steps in for the veteran as India look to defend their title on home soil.

ALSO READ: IPL 2027 auction set for December 16 in Goa; Retention deadline fixed for November 15

A Heartbreak On Home Turf

The injury robs Manpreet of a historic personal milestone. Having debuted at the tournament's inaugural edition in Ordos in 2011, the 34-year-old Manpreet was set to become the first hockey player in Asian history to compete across eight separate editions of the Asian Champions Trophy.

Even more poignant is the venue. With the tournament hosted in Punjab, Manpreet was scheduled to play before his home crowd.

"It is a huge disappointment. It was a big opportunity to play on my home ground, but now I won’t be playing. This is where I started playing hockey, and I was so excited.
Hyderabad: Amid the ongoing trolling over their appearance on 'Koffee With Karan', Vijay Deverakonda and Rashmika Mandanna’s team have filed a formal complaint with the Hyderabad Cyber Crime authorities, seeking an impartial investigation into specific online content targeting them.
The complaint identifies online publications and digital material across social media platforms, including alleged false narratives, fabricated content, manipulated screenshots, impersonation and targeted online harassment. Relevant links and supporting evidence have been submitted for examination by the authorities.
The couple's team hopes "the matter will be investigated in accordance with the law and that the deliberate creation and circulation of misleading narratives, including any coordinated or paid campaigns established through evidence, will be addressed appropriately."
"Every identified instance of publishing, reposting or amplifying potentially unlawful content may be examined on its own merits. Appropriate legal remedies will be pursued wherever warranted, in accordance with due process," read a statement by Vijay's team.
However, an official confirmation from the police regarding the matter is still awaited.
Earlier, on Monday afternoon, both Rashmika and Vijay took to their respective Instagram accounts to call out the trolls.
"My best friend, my wife, my woman. One of the most beautiful parts of my life that I got absolutely right. For all those concerned, We are both gloriously happy. I am blessed. If its me and her against the world - so be it. Big love to all those who celebrate love and the simplicity of living happily. Now, with absolutely no intended kindness or respect, everyone else can go fuck themselves," Vijay's post read.
Since the episode aired last week, the couple has been facing severe online trolling over several revelations they made about their relationship.
Several clips from the episode circulated online, evoking mixed reactions from the netizens. One of the moments that drew particular attention was Vijay’s revelation that Rashmika had to propose to him nearly 100 times before he agreed to marry her.Reacting to this, many social media users labelled Vijay “red flag".
Before Vijay, Rashmika took to Instagram to respond to the ongoing controversy.
“My lil’ 2 cents on this whole issue concerning me and Vijju. I generally don’t address these things because everyone has a right to their opinions. Sometimes, I even enjoy reading them and gaining a different perspective. But the current frenzy over our interview feels less like people having opinions and more like an angry mob looking for someone to vent at. Somewhere along the way, the whole point got lost. Maybe it didn’t fit your lens. Maybe some of you simply don’t want to see it. I’m writing this because I want to protect the people who believe in love, and I hope everyone gets to find their own version of it,” she posted.
“We’ve been bombarded with opinions, comments and unsolicited advice on all our profiles, mine and yours, unnecessarily. The conviction with which people came at us genuinely shook me a little. I was like, WHAT THE FK IS GOING ON? So I took a step back, thought about it, and here’s my lil’ take on my own life. First, it was never about the number of times or an entire year. That’s where some of you got stuck. Yes, that conversation happened. But neither of us was looking for a grand proposal. The conversation was about him wanting both of us to take the time and space to understand each other, to be sure that despite all the highs and lows, the joys and stresses of life, this was what we wanted and the right time for it.And we did. We chose each other. It’s okay that I knew exactly what I wanted. And it was equally okay that he wanted time to think all the practical things of life through and be sure. That didn’t change our love in any way. I am all heart and he is the thinker- and we need that in each other’s lives. For us, marriage was never about a proposal, getting down on one knee or putting a ring on a finger. That’s the decorative part. For us, it was about building a life and a future together. And I think we did that beautifully so far,” she added.
Rashmika also questioned how being obsessed with someone you love could ever be a bad thing, proudly admitting that she’s obsessed with Vijay.
“Find someone you would go to any lengths for, someone who would do the same for you. And yes, I am OBSESSED with my man. When did that become a bad thing? If I’m not IN LOVE with the man I’m marrying, then why in the world would I marry him? He’s going to be my companion for life. My friend through the ordinary days and the extraordinary ones. The father of my children. The man I grow old with. Find a man who loves you so beautifully that even after you’re married, you’d still want to tell him, ‘Let’s get married.’ I would do it a thousand times – 100 is nothing. It’s really that simple,” she wrote.
Rashmika urged everyone to refrain from speaking ill of her or her family, making it clear that she wouldn’t tolerate any disrespect towards them.
“Bitch about me all you want. I can take it. But talking about my family without knowing them? That’s not feminism. That’s bullying dressed up as feminism. Feminism was never about putting someone else down or establishing superiority, whether you’re a man or a woman. It was always about having the freedom to choose your own life and taking charge of it. I took charge of mine,” she expressed. In her note,
Rashmika also opened up about how Vijay has always been by her side through thick and thin.
“Right now, I am the happiest I have ever been. And I hope you can see that in my face, in the joy I’ve felt since getting married, in my performances, in my films, and simply in the way I live my life.I am happy. I am content. I am blessed. And the fact that some people would rather believe random narratives, misleading edits and absolute lies created on the internet that believe what I say about my own life is honestly a little creepy. When I snap a bone, you aren’t there. He is. When my stomach hurts every month, you aren’t there. He is. When I need to go to the hospital, you aren’t there. He is. When I wake up in the middle of the night with anxiety, you aren’t there. He is. And when I break down, I don’t have your shoulder to cry on. I have his. So please, don’t worry about me or him. I genuinely wish and pray that you find someone you love who loves you just as deeply. And if that isn’t what you want for yourself, that’s completely fine too. Live the life that makes you happy,” she said.
Rashmika concluded her note with a shout-out to her fans who have always loved her and supported her.
“And it rewarded me with immense love ….And to some of my Kannadiga friends… Ahhh, how lovely it is to know that I’m still so deeply etched in your hearts even after 10 years. For you to still be celebrating me after all this time… truly, I’m blessed! Love to all those who celebrate love and joy. And to everyone else… please find something that makes you happy, too,” she signed off.
Rashmika and Vijay tied the knot in Udaipur on February 26, 2026.

Former Tamil Nadu BJP president K Annamalai has urged the Centre to exempt small retailers from Merchant Discount Rate (MDR) charges on Unified Payments Interface (UPI) transactions, arguing that protecting local businesses should take precedence over generating revenue from digital payments.

Speaking at a state-level retailers’ convention organised by the All India Mobile Retailers Association (AIMRA) in Udupi, Karnataka, on October 24, Annamalai called on the government to reconsider the policy and subsidise digital payment infrastructure rather than place additional costs on traders.

“UPI is like a hen that lays a golden egg every day. If you kill it expecting to get a hundred eggs at once, you will end up with nothing,” he said, warning that introducing charges could undermine a payment system that has become part of everyday life across India.

The remarks were made at Town Hall in Ajjarkad, Udupi, a coastal Karnataka district where the BJP has traditionally enjoyed a strong electoral presence. Annamalai, who began his career as an Indian Police Service (IPS) officer in the region, has since launched a political movement called We The Leaders.

Annamalai questions cost of UPI infrastructure

Annamalai said the estimated Rs 15,000 crore linked to the charges was relatively small compared with the Centre’s annual budget of around Rs 50 lakh crore.

He questioned why the government could not treat spending on UPI as an investment in the country’s economic growth.

"The government says that money is spent from the public exchequer to facilitate UPI transactions. But why can't the government consider this an investment in improving the country's economy?" he asked.

The Centre introduced a revised MDR framework in September 2026, ending the blanket zero-MDR regime for specified merchant transactions. Under the framework, a 0.4% MDR applies to eligible merchant payments above Rs 2,000, subject to prescribed caps and exemptions.

The government has maintained that customers will not be affected and that around 96% of merchant transactions will remain unaffected. Small merchants covered by the zero-MDR provisions will continue to be exempt.

The National Payments Corporation of India (NPCI) deferred the introduction of the revised charges on October 13 until after Diwali.

Annamalai argued that UPI's widespread adoption was driven in large part by the decision to keep transactions free in 2020. Its reach among rural users and people unfamiliar with English, he said, showed how accessible digital payments could change everyday commerce.

He also raised concerns about the impact of charges on businesses operating on narrow margins, calling on the Union Finance and Commerce ministries to work together to provide relief to small retailers.

He urged the government to consider subsidising payment infrastructure rather than placing additional costs on merchants.

Calls for stronger domestic retail and manufacturing

Annamalai's objections extended beyond digital payments to the wider impact of government policies on local businesses.

He said small retailers create jobs, keep money circulating within communities and contribute to regional economic growth. He also warned that profits generated by large corporations could flow abroad, limiting the economic benefits for local communities.

Calling for greater domestic manufacturing, Annamalai said India should move beyond the Centre's Make in India initiative towards what he described as "Make for India", with a stronger focus on domestic production and the needs of Indian consumers.

He urged local MPs to raise retailers' concerns in Parliament and press the Finance Ministry to ensure multinational companies operate within a framework that does not disadvantage smaller domestic businesses.

Annamalai's return to his former police posting

Annamalai's remarks in Udupi carry a local significance. He began his police career as Assistant Superintendent of Police in Karkala in September 2013 and took charge as Superintendent of Police of Udupi district on January 1, 2015. He served in the district until his transfer to Chikkamagaluru in July 2016.

He later served as Superintendent of Police in Chikkamagaluru and Deputy Commissioner of Police in Bengaluru South before resigning from the Indian Police Service in 2019.

Annamalai joined the BJP on August 25, 2020, and became the party's Tamil Nadu president in July 2021.

He held the post until April 2025, when Nainar Nagenthran succeeded him.

During his tenure, Annamalai sought to expand the BJP's presence in Tamil Nadu, where the party has struggled to challenge the dominance of the Dravidian parties.

Since stepping down from the leadership role, he has increasingly questioned decisions associated with the BJP and the Union government.

The BJP has maintained a strong electoral presence in coastal Karnataka, with party candidates repeatedly winning Assembly and parliamentary elections in Udupi and neighbouring Dakshina Kannada.

Annamalai's earlier police service in the region has given his return a distinct local resonance.

Kolkata: Eminent painter Jogen Chowdhury passed away at a private hospital in Kolkata on Sunday morning following a prolonged battle with a rare blood cancer at the age of 87 years.
Apart from being a painter, Jogen was also a former Member of Parliament (MP), representing the Trinamool Congress (TMC). He had been suffering from a myeloproliferative neoplasm, a rare type of blood cancer, for the past 14 months and was undergoing chemotherapy, Ruby General Hospital said in a statement.
Jogen's wife, Sipra Chowdhury, paid her last respects to the mortal remains of the painter after the body was transferred from Ruby General Hospital.
The brother of Jogen Chowdhury, Manindranath Choudhuri, expressed his sorrow after the demise of his brother. He shared the love of Jogen for paintings and art.
While sharing his remorse, Manindranath said, "I can't believe Jogen Chowdhury will be leaving like this. He had a lot of dreams—always wanting to organise things since he was a kid, and just the way he is. So suddenly getting a disease like this was beyond our imagination. We never thought it would happen. We argued a lot with the doctor about why this was happening and what was going on. We asked if there was any possible treatment. But they couldn't do anything."
He continued, "I've grown up doing cultural programs, running the cultural club, and things like that. He still wants to do a bit more, maybe. There are already three organisations right here in Charubasna. Then we have our Nandimukh Sansad. We're always doing some kind of creative stuff. We don't even have enough time for painting. Ever since childhood, he had an overly ambitious desire to do everything."
Wife Sipra Chowdhury was at a loss of words following her husband's demise. She called it a painful moment of her life. While talking to ANI, she said, "It's very painful for me. We got married in 1970. We worked together for a long time."
Artist Samir Aich, who arrived to pay his last respects to Jogen, described the painter's demise as a "shock to India." He paid tribute to the painter by remembering the legacy of Jogen's works, which will continue to inspire his students and followers.
While talking to ANI, Samir Aich said, "This shock is not just for me, but for the whole of India and Bengal. We have to see days like this. This is a part of life, but it's really hard to bear. Jogen was one of the most important artists in modern painting in India. Such a good painter and a good artist. It's a loss for us. It's very hard to fill this void. This is a very sad thing for so many of us."
He added, "Jogen has so many students, he takes so many modern classes, and he has so many paintings. Look, many of their paintings are in a museum in Japan. They have many paintings. He has a museum in Kiran Nadar. But all over the world, many collectors have his paintings. We also have some that will remain. Jagendra Choudhury is no more today, but it's true that his paintings will remain in the world forever."
Earlier, West Bengal Chief Minister Suvendu Adhikari expressed his sorrow on the passing of Jogen Chowdhury on Sunday. He paid tribute to the painter by calling him a "towering pillar" of India's cultural world.
Penning a note on his X handle, CM wrote, "Deeply pained and grieved by the passing away of eminent painter and legendary artist, Shri Jogen Chowdhury. A maestro whose distinctive strokes redefined Indian modern art, Shri Jogen Chowdhury was a towering pillar of our cultural world. His immense contributions brought international acclaim to West Bengal. His departure leaves an irreparable void in West Bengal's intellectual and artistic soul. On behalf of the Government and the People of West Bengal, I express my profound grief and extend my heartfelt condolences to his bereaved family, friends, associates and legions of fans across the globe. Om Shanti."
According to the website of Jogen Chowdhury, which comprises his works, including the photographs of his portraits and paintings, the painter was born on 16 February 1939.
"Educated at the Government College of Art & Craft, Calcutta and subsequently at École Nationale Superieure des Beaux Arts, Paris, Jogen is one painter who has inspired young artists of contemporary India, in a significant way," added the website.
The demise of Jogen Chowdhury is a significant loss to India’s cultural and artistic landscape. While his passing leaves an irreplaceable void, his extraordinary paintings and artistic legacy will continue to inspire generations. His contributions to Indian art will be cherished and remembered for years to come

Initially, they had been placed on a three-day transit remand. During that transit remand, they were subjected to extensive interrogation. Furthermore, the police requested an extension of their custody from today until the 31st. However, all relevant items, including their mobile phones, SIM cards, and bank debit cards, have already been recovered. So, the question arises: why would the police require further custody? That was the core of our argument today. The court has remanded them until the 28th. The IO stated that accused Ankit had travelled to Mumbai to conduct a recce, accused Samir was in direct contact with one Anil Pandit, and Jatin Panchal had allegedly procured the weapons used by accused Ankit and Samir. Citing their direct involvement in executing the conspiracy, the police sought their custodial interrogation.
Appearing for the state, Public Prosecutor Kranti Kumbhar pushed for an extended remand till October 31, arguing that several wanted individuals linked to the case are currently outside Maharashtra, requiring inter-state investigation.
"Most of the wanted accused connected to the present accused are out of state, and this needs a thorough investigation, which is a time-taking process. The hotel register has also been seized, but further investigation is needed on all these aspects. As we all know, it is a case of conspiracy and conspiracy is hatched in secrecy, so this needs to be investigated in detail. Therefore, a longer duration is a must in this case," the Public Prosecutor argued.
Opposing the police remand, defence counsel Ajinkya Mirgal pressed for judicial custody, contending that the police had already completed their recoveries and had no substantial ground to demand extended custody.
Speaking to the media after the hearing, Advocate Mirgal said, "According to the police's own submission, they have already seized the hotel registers, the crime scene footage, and the CCTV recordings showing our clients were not present at the spot. If all recoveries have already been completed, why is police custody required on the exact same grounds?"The defence counsel also questioned the claims regarding the alleged weapon. Despite making around ten arrests, if they are still unable to recover the weapon, it raises serious doubts about whether such a weapon actually exists," Mirgal said.
Addressing the police's claim that two of the accused were in phone contact with wanted accused Anil Pandit, Mirgal argued that since the mobile phones of the accused have already been seized, forensic experts can independently verify call detail records without requiring custodial interrogation.
He also argued that taking them back to Sonipat until October 31 was unwarranted when they were just brought to Mumbai from there within 48 hours.
The Supreme Court on Monday issued notice to the Election Commission of India (ECI), the Centre, the Chief Electoral Officer and the Maharashtra government on a petition challenging the Special Intensive Revision (SIR) of electoral rolls in Maharashtra over alleged large-scale voter deletions.

However, the court declined to extend the deadline for filing claims and objections or halt publication of the final voters’ list without first hearing the poll body.

A Bench comprising Chief Justice of India (CJI) Surya Kant and Justices Joymalya Bagchi and V. Mohana scheduled the next hearing for November 5.

The petition, filed by Arun Anandagiri, challenges the deletion of names from the draft electoral rolls and the procedure prescribed for voters seeking to have their names restored.

Plea flags deletion of nearly 3 crore voters

Appearing for the petitioner, senior advocate Arvind P. Datar told the court that nearly 33 per cent of Maharashtra’s approximately nine crore voters, around three crore people had been removed following the publication of the draft electoral rolls.

Of these, 1.22 crore voters had been deleted on the ground of “logical discrepancy”, Datar submitted.

He argued that voters whose names had been removed were being asked to submit Form 6, which is intended for fresh voter registration, despite having voted in previous elections.

According to the senior advocate, this requirement could expose existing voters to allegations of making a false declaration, as applicants must state that they have not been registered as voters previously.

Referring to a recent Delhi High Court order, Datar argued that an assurance against prosecution did not address the underlying issue. He urged the Supreme Court to direct the ECI to introduce a separate form for voters whose names had been deleted during the revision exercise.

“Nobody will be prosecuted,” the Bench led by CJI Surya Kant assured the petitioner’s counsel.

Court reluctant to grant immediate relief

Datar also sought an extension of the deadline for filing claims and objections, which fell on Monday, and asked the court to restrain the ECI from finalising the electoral rolls until the dispute was adjudicated.

He argued that Maharashtra did not face any immediate election that required the list to be finalised according to the existing schedule.

The Bench, however, was reluctant to pass an order without first hearing the poll body. It noted that the Supreme Court had extended deadlines during SIR exercises in other states and indicated that appropriate directions could be considered after examining the circumstances.

The matter will now be taken up on November 5.

Maharashtra SIR schedule

Under the revised schedule, the draft electoral roll in Maharashtra was published on August 31, while the deadline for filing claims and objections was extended until October 26.

The disposal of claims and objections is scheduled to continue until November 10. The final electoral roll is due to be published on November 16.

Supreme Court had earlier upheld ECI’s authority

The Supreme Court had previously upheld the ECI’s authority to conduct the SIR exercise, ruling that the revision fell within the poll body’s constitutional and statutory powers. The exercise, it said, was intended to protect the integrity of electoral rolls and ensure free and fair elections.

In its judgment delivered on May 27, the apex court held that the exercise was authorised under Article 324 of the Constitution, read with Section 21(3) of the Representation of the People Act, 1950.

The court also ruled that procedural safeguards were in place to prevent arbitrary exclusion from electoral rolls.

It further clarified that the ECI could examine questions relating to citizenship for electoral purposes, while making clear that such scrutiny would not amount to a final determination of an individual’s citizenship.

(with IANS inputs)

He argued that voters whose names had been removed were being asked to submit Form 6, which is intended for fresh voter registration, despite having voted in previous elections.
